Nature of Non-Recourse Funding
SettleUP provides non-recourse pre-settlement funding based on the potential proceeds of a legal claim. It is not a traditional recourse loan based on a client's personal income or assets. Repayment is made from proceeds of the funded claim and is governed by the applicable written funding agreement.
The phrase "No Recovery, No Repayment" means that if there is no recovery on the funded claim, the client owes SettleUP nothing under the funding agreement, subject to the agreement's terms, representations, and obligations. The executed funding agreement—not this Website—defines the parties' rights and responsibilities.
Cost and Effect on Recovery
Pre-settlement funding has a cost and will reduce the amount a client ultimately receives from a settlement, judgment, or other recovery. It may be more expensive than other sources of funds. Those matters remain between the client and the client's attorney. SettleUP does not guarantee or require any particular case outcome.
No Guarantee of Approval, Timing, or Results
Every funding request is evaluated individually. Approval, amount, terms, and timing depend on case-specific facts, documentation, verification, applicable requirements, and SettleUP's discretion. References to funding "within hours" or an average funding time describe typical past experience after approval and completion of required documentation; they are not guarantees.
SettleUP makes no promise regarding a claim's value, duration, settlement, judgment, recovery, or net proceeds. Past transactions and results do not predict future outcomes.
Attorney Referrals and Relationships
An attorney's submission of a request or referral of a client does not make the attorney an agent, partner, guarantor, or representative of SettleUP. SettleUP's relationship with a law firm does not imply that SettleUP endorses the firm or that the firm endorses or guarantees SettleUP. The attorney remains independently responsible for legal services, and SettleUP remains independently responsible for its funding obligations.
