These Terms of Use (the "Terms") govern access to and use of settleupfunding.com (the "Website"), which is operated by SettleUP Funding ("SettleUP," "we," "us," or "our"). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
1. Eligibility and Authority
You must be at least 18 years old to use the Website. If you use the Website on behalf of a law firm, company, or other organization, you represent that you have authority to act for that organization and bind it to these Terms.
2. Website Information Only
The Website provides general information about SettleUP and non-recourse pre-settlement funding. Website content is not an offer, approval, commitment, quote, or promise to provide funding. It is also not legal, financial, tax, investment, medical, or other professional advice.
Use of the Website does not create an attorney-client, fiduciary, advisory, agency, partnership, or joint-venture relationship between you and SettleUP.
3. Funding Requires a Separate Written Agreement
Submitting an inquiry, sending an email, speaking with SettleUP, or providing case information does not guarantee approval and does not create a funding agreement. Each request is subject to review, verification, applicable requirements, and SettleUP's discretion.
Funding is provided only after all required parties complete a separate written agreement. That agreement states the actual funded amount, payoff schedule, representations, authorizations, and other transaction-specific terms. If Website content or these Terms conflict with an executed funding agreement, the executed funding agreement controls with respect to that transaction.
4. Non-Recourse Funding and Attorney Independence
SettleUP provides non-recourse funding based on a potential recovery from a legal claim. Repayment obligations are governed exclusively by the applicable written funding agreement.
SettleUP does not provide legal representation and does not control legal strategy, litigation, settlement decisions, or an attorney's professional judgment. Clients and attorneys remain solely responsible for the handling and resolution of a claim. Nothing on this Website should be interpreted as directing a client to accept or reject a settlement.
5. No Guarantee of Approval, Timing, or Outcome
Funding availability, amount, terms, and timing depend on the facts and circumstances of each request. References to typical review or funding times describe past experience and are not guarantees. SettleUP does not guarantee any case outcome, settlement, judgment, recovery amount, or time to resolution.
6. Communications and Submissions
If you contact SettleUP, you authorize us to respond using the contact information and communication method you provide. Standard telephone, text, or data charges may apply. An inquiry does not, by itself, constitute consent to receive unrelated marketing communications.
Ordinary email and text messages may not be secure. Do not send Social Security numbers, complete financial-account information, passwords, government identification documents, or detailed medical records unless SettleUP has requested the information and directed you to an appropriate submission method.
You represent that information you submit is accurate to the best of your knowledge and that you have the right and authority to provide it. You may not submit confidential or personal information about another person unless you are authorized to do so.
7. Permitted Use
SettleUP grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Website for lawful, informational, and business purposes consistent with these Terms.
You may not:
- Use the Website in violation of law, regulation, court order, or another person's rights;
- Misrepresent your identity, authority, affiliation, or the source or accuracy of submitted information;
- Attempt to gain unauthorized access to the Website, its systems, accounts, or data;
- Interfere with Website operation, security, or availability, including by introducing malicious code or excessive automated requests;
- Scrape, copy, republish, frame, or commercially exploit Website content except as permitted in writing by SettleUP or by applicable law; or
- Use SettleUP's name, marks, or content in a deceptive, defamatory, infringing, or misleading manner.
8. Intellectual Property
The Website and its text, design, graphics, logos, photographs, arrangement, and other content are owned by SettleUP or used with permission and are protected by intellectual-property laws. No license or ownership right is granted except the limited right to use the Website under these Terms. SettleUP Funding and related names, logos, and branding may not be used without prior written permission.
9. Third-Party Links and Services
The Website may link to third-party websites or services for convenience. SettleUP does not control and is not responsible for their content, availability, security, terms, or privacy practices. A link does not necessarily imply endorsement. Your use of a third-party service is governed by that provider's terms.
10. Website Availability and Changes
We may update, suspend, restrict, or discontinue all or any part of the Website at any time. We do not guarantee that the Website will be uninterrupted, error-free, secure, or compatible with every device. We may correct errors or update content without notice.
11. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." SETTLEUP DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AND UNINTERRUPTED AVAILABILITY.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SETTLEUP AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS OPPORTUNITY; OR DAMAGES ARISING FROM OR RELATED TO ACCESS TO, USE OF, INABILITY TO USE, OR RELIANCE ON THE WEBSITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. These limitations apply only to the Website and do not alter obligations expressly stated in an executed funding agreement.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless SettleUP and its owners, officers, employees, and agents from third-party claims, damages, liabilities, judgments, costs, and reasonable attorneys' fees arising from your unlawful misuse of the Website, your material violation of these Terms, or information you submit without the required right or authority.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any dispute arising solely from the Website or these Terms must be brought in a state court located in Bartow County, Georgia, or, if federal jurisdiction exists, in the United States District Court for the Northern District of Georgia. You consent to the personal jurisdiction and venue of those courts. A separate written funding agreement may contain different or additional dispute terms that govern that transaction.
15. General Terms
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted by law. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement regarding use of the Website and supersede prior discussions concerning Website use.
16. Changes to these Terms
We may revise these Terms from time to time. The "Last updated" date identifies the most recent revision. Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms.
